1 By entering this promotion all participants will be deemed
to have accepted and be bound by the terms and conditions
and by any other requirements set out in the promotional material.
The decision is final and binding in all matters. Correspondence
will not be entered into. Please retain these terms and conditions
for future reference.
2 For the purpose of this Contest, in these Terms and Conditions
(i) “Citadel” means Citadel
Commerce, myCitadel Wallet, Citadel Checks and any of its
subsidiary companies.
(ii) “Transfer” means a transfer of currency units
from a Citadel member’s Wallet account to any valid
merchant site and does not include transfers from merchant
sites back to Citadel Wallet account
(iii) “Deposit” means a transfer of currency units
from a Citadel member’s bank account, credit card or
debit card to their valid and activated Citadel member’s
Wallet account and does not include deposits or transfers
from the Citadel member’s Wallet account back to their
bank account or credit card or debit card.
3 This Contest is open to existing holders of US and Canadian
Citadel accounts (“Citadel members”) aged 18 years
or over (or the age of majority in the Citadel member’s
country of residence, whichever is greater, except residents
of the Province of Quebec, Canada). Employees of Citadel,
its agencies, anyone professionally associated with the promotion,
and their respective families are not permitted to enter.
4 The contest period runs from 00.00.01 Eastern Standard Time
September 1, 2006 to 23.59.59 Eastern Standard Time November
15, 2006.
5 The Early Bird Prize for the Contest will be drawn at random
under independent supervision on October 18, 2006
6 The Grand Prize for the Contest will be drawn at random
under independent supervision on November 18, 2006
7 Citadel reserves the right to delay the cash prize draw
due to technical issues outside its control.
8 To be able to participate in the Contest, Citadel members
must have an activated myCitadel Wallet account. No purchase
necessary to be able to participate in the contest.
9 Citadel members will be given an “entry” for
each transfer of funds from the Citadel member’s Wallet
account to the merchant site. Only cleared transactions (transactions
where funds have cleared through the Citadel system) will
be counted for entry. Only transactions that have cleared
by the time of each draw will be counted. Should a transaction
not clear before the Early Bird Prize, the transaction will
be automatically passed into the draw for the Grand Prize.
Should a transaction not clear before the Grand Prize, the
entry will be forfeited. Entries garnered from transactions
from Citadel members’ accounts can be accumulated across
the Early Bird Prize and Grand Prize
10 Citadel members will be given an “entry” for
when a Citadel member orders a SecureSwipe Device. Citadel
members will be given another “entry” for activating
a SecureSwipe device. The Citadel member’s account must
also be in good standing in order to be eligible for a SecureSwipe
device. Citadel members whom already have received a SecureSwipe
device before the Contest date will receive an automatic “entry”
for the Contest. Citadel members whom already have received
a SecureSwipe device and has the SecureSwipe device activated
before the Contest date will receive an additional automatic
“entry” for the Contest.
11 Consumers who wish to enter the Contest and are not a Citadel
member must first sign up for a myCitadel Wallet account at
www.myCitadel.com. The Consumer must not nor has in the past
been a Citadel member in order to be eligible and receive
that entry. Once an account has been successfully set up and
activated, the new Citadel Member will receive an “entry”
for the Contest. The new Citadel member will also be eligible
to be awarded additional entries by Citadel as per points
9 and 10 above.
12 Citadel members whom already have activated myCitadel Wallet
account which is in good standing before the Contest start
date will receive an automatic “entry” for the
Contest
13 Citadel reserves the right to disqualify any entries from
Members whose account is not in good standing and from Members
who breach the promotion Terms and Conditions or Citadel Terms
and Conditions.
14 The chances of winning depend on the number of eligible
entries received within each prize draw. Winners are eligible
to receive only one prize draw per prize draw. All taxes on
prizes are the sole responsibility of the prize winners
15 Entries will close at midnight Eastern Standard Time 3
days before the prize draw date: (i) Early Bird Prize Draws
will take place on October 18, 2006; (ii) Grand Prize Draws
will take place on November 18, 2006.
16 The winner will be notified within 14 days by email. Citadel
accepts no responsibility for emails lost due to a mal-transmission.
Should Citadel receive no response within two weeks of the
initial notification, a second email will be sent. If Citadel
receives no response within 2 months of the second notification,
the prize will be forfeited. The prize will not be re-drawn.
17 Before being declared a winner, a Member must be in compliance
with these Terms and Conditions and have their eligibility
and identification verified by Citadel. Winners of cash prizes
may be required to sign a Declaration and Release form, acknowledging
the receipt of the prize and releasing the Citadel from any
and all liability. Winners may also be required to answer
a skill-testing question before being declared a winner.
18 There may be more than one route to entry for this Contest.
Citadel reserves the right to run supplementary promotions
or advertisements on third-party websites (sites where Citadel
members use their Citadel accounts and elsewhere).
19 By entering the Contest, Citadel members consent to the
disclosure by Citadel (if they are selected as a winner) of
their name (first name, first initial of their last name only)
and country of residence on the promotional websites.
20 Citadel will use third parties to facilitate one or more
elements of this promotion and may provide some of your personal
information to them. These third party providers are subject
to confidentiality agreements with Citadel and other legal
restrictions that prohibit the use of the information provided
for any other purposes except to facilitate the specific outsourced
Citadel operations linked to this promotion.
21 Citadel reserves the right to cancel or make any changes
to the promotion at any stage if deemed necessary in their
opinion and if circumstances arise out of their control.
23 Citadel reserves the right to invalidate any entries should
the Citadel member reverse the qualifying transfer after the
transfer has been made
24 Citadel accepts no responsibility for any incorrect or
inaccurate information and assumes no responsibility for any
errors or omissions in communication or transmission, lost
or delayed entries. Citadel shall not be liable, to the fullest
extent permitted by law, in contract or tort (including negligence)
or the breach of statute or in any other way, for the loss
or damage howsoever arising suffered by any Member or other
person resulting directly or indirectly from participation
in this promotion or attempting to participate in this promotion.
25 By agreeing to these terms and conditions, you acknowledge
your consent to receive additional email communications from
Citadel relating to this promotion. If you choose not to receive
additional marketing communications relating to this promotion,
please follow the ‘Opt-out’ procedure described
within Citadel Terms and Conditions and Privacy policies.
26 Upon 30 days notice to all Customers, Citadel reserves
the right at all times to vary the conditions of the Rules.
27 This promotion is governed by the laws of the Province
of British Columbia, Canada. All disputes arising out of or
in connection with this Agreement shall be referred to and
finally resolved by arbitration or mediation under the rules
of the British Columbia International Arbitration Centre.
The place of arbitration of mediation shall be Vancouver,
British Columbia, Canada. By accepting these terms and conditions
you confirm that you are not breaching any laws in your country
of residence regarding the legality of entering our promotion.
Citadel will not be held responsible for any entrant entering
unlawfully. If in any doubt you should immediately leave the
website and check with the relevant authorities in your country.
